Terms of Service

Please read these Terms of Service carefully before using Windy Tracker. By creating an account or using our service, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing or using Windy Tracker (“the Service”), you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and agree to these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Account Responsibility

When you create an account, you are responsible for:

  • Maintaining the confidentiality of your credentials (password or magic link access)
  • All activity that occurs under your account
  • Notifying us immediately if you suspect unauthorized access to your account

You may not share your account with others or transfer it to another person. We reserve the right to suspend accounts that show signs of unauthorized use.

3. Acceptable Use

Windy Tracker is designed for uploading and visualizing offshore racing route files. You agree not to:

  • Upload files containing malicious code, malware, or content designed to harm the Service or other users
  • Attempt to reverse-engineer, scrape, or otherwise extract data from the Service beyond what is provided through normal use
  • Use the Service for any unlawful purpose or in violation of any applicable regulations
  • Circumvent usage limits or credits through automated means
  • Upload files that are not route data, or that exceed the file size limits displayed in the application

We reserve the right to remove any uploaded content and terminate accounts that violate these guidelines.

4. Credits and Billing

Credit System

Windy Tracker operates on a credit-based system:

  • New accounts receive 10 free conversion credits upon registration
  • 1 credit = 1 route file conversion
  • Additional credits are purchased in batches: 10, 100, or 1,000 credits
  • Payments are processed securely through Stripe

Pricing

Credit batch prices are displayed on the pricing page and may be updated from time to time. The price in effect at the time of purchase applies to that transaction.

Refund and Cancellation Policy

Credits are non-refundable once purchased. We do not offer refunds for unused credits, partial credit balances, or purchases made in error. If you believe a charge was made in error due to a technical fault on our end, please contact us within 14 days and we will investigate.

Unused credits do not expire and remain available in your account indefinitely.

Payment Processing

All payments are processed by Stripe. We do not store your payment card details. By making a purchase, you also agree to Stripe’s Terms of Service.

5. Intellectual Property

Your Route Data

You retain full ownership of the route files you upload. By uploading a file, you grant Windy Tracker a limited, non-exclusive license to:

  • Process and convert your route file to our internal JSON format
  • Store the converted JSON on Cloudflare R2 storage to enable the route visualization feature
  • Serve the JSON to authorized requests using your route code

This license exists solely to provide the Service to you and terminates when you delete the route or your account.

Our Platform

All software, designs, and systems that make up Windy Tracker are the intellectual property of Windy Tracker and its developers. You may not copy, modify, or distribute any part of the platform without our written consent.

6. Data Retention

  • Route files and their converted JSON are stored until you explicitly delete them from your dashboard
  • Deleting a route removes the source file from private storage and the converted JSON from public storage
  • Deleting your account removes all associated route data, conversion history, and personal information from our systems within 30 days

7. Limitation of Liability

To the maximum extent permitted by applicable law, Windy Tracker and its operators shall not be liable for:

  • Any indirect, incidental, special, or consequential damages arising from your use of the Service
  • Loss of data resulting from hardware failure, network interruption, or unauthorized access
  • Decisions made based on route visualizations displayed through the Service

The Service is provided “as is” without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that route data will be preserved indefinitely.

Windy Tracker is a planning and visualization tool. It is not a substitute for certified navigation equipment, official charts, or professional routing advice. Always comply with maritime safety regulations.

8. Termination

By Us

We may suspend or terminate your account if you:

  • Violate these Terms of Service
  • Engage in abusive, fraudulent, or harmful activity
  • Fail to pay for services (if applicable)

We will make reasonable efforts to notify you before termination unless immediate action is required to protect the Service or other users.

By You

You may delete your account at any time from your account settings. Deletion is permanent and cannot be undone. Credits remaining at the time of deletion are forfeited.

9. Changes to These Terms

We may update these Terms of Service from time to time. We will notify registered users of material changes by email. Your continued use of the Service after any changes constitutes acceptance of the revised terms.

10. Governing Law

These terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved in the jurisdiction where Windy Tracker operates.
